SOCIAL INVESTIGATION FOR THE MEDICAL ASSESSMENT COMMISSION FOR ADULTS WITH DISABILITIES

Persons with disabilities are those persons whose physical, sensory, mental, intellectual and / or associated impairments, in an unadapted social environment, totally prevent or limit their access to society on equal terms, requiring protection measures to support their social integration and inclusion.

Social, medical, psychological and educational assessment and the classification / reclassification by degree of disability is carried out by the Service for the Complex Assessment of Adults with Disabilities, within the General Directorate for Social Welfare and Child Protection, on the basis of the documents requested by DGASPC.

Among the required documents is the social investigation carried out by the public social welfare service of the locality of residence.

What is the applicable legislation?

  • Law no. 448 of 2006, republished, on the protection and promotion of the rights of persons with disabilities
  • Decision no. 268 of 2007, as updated, approving the Methodological Norms for the implementation of the provisions of Law no. 448/2006 on the protection and promotion of the rights of persons with disabilities
  • Government Decision no. 430/2008 approving the Methodology for the organisation and operation of the assessment commissions for adults with disabilities;
  • Law no. 190 of 2018 on measures for the implementation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)

Submission of an application accompanied by the following documents:

  • other medical documents, as applicable
  • identity document of the person with disability – original;
  • identity document of the representative, as applicable – original;
  • medical referral – issued by the specialist physician – copy;
  • medical letter – issued by the family doctor – copy;
  • certificate of disability classification (only when the social investigation is carried out for the review of the degree of disability) – copy
