SOCIAL INVESTIGATION FOR THE COMMISSION FOR THE PROTECTION OF THE CHILD – ASSESSMENT OF DEGREE OF DISABILITY OF THE CHILD
The classification of children by degree of disability involves a complex assessment of their functioning, taking into account medical, psychological and social aspects, and not only the medical diagnosis.
The main purpose is to ensure benefits, such as financial allowances, access to specialised educational services, recovery therapies and other support measures adapted to the specific needs of each child.

What is the applicable legislation?
- Law no. 448 of 2006, republished, on the protection and promotion of the rights of persons with disabilities
- Decision no. 268 of 2007, as updated, approving the Methodological Norms for the implementation of the provisions of Law no. 448/2006 on the protection and promotion of the rights of persons with disabilities
- Order no. 1,985 of 2016 approving the methodology for the integrated assessment and intervention for the classification of children with disabilities by degree of disability, the school and professional orientation of children with special educational needs, and the abilitation and rehabilitation of children with disabilities and / or special educational needs
- Order no. 1,306 of 2016 approving the bio-psycho-social criteria for the classification of children with disabilities by degree of disability and the methods of their application
- Law no. 292 of 2011 on social welfare
- Law no. 190 of 2018 on measures for the implementation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)
Application accompanied by the following documents;
- Proof of income of parents / legal representatives – if applicable – copy; this must be presented to DGASPC
- Child’s identity documents (birth certificate, ID card) – original
- Identity documents of parents / legal representatives (ID, identity card) – original
- Death certificate of parent, civil divorce decision, guardianship, tutorship, placement – where applicable – copy
- Type A 5 medical certificate issued by the specialist physician – copy
- Synthetic medical record issued by the family doctor – copy
- Psychological assessment sheet – copy; mandatory at the first assessment of the degree of disability, then only if requested by DGASPC, depending on the child’s diagnosis
- Certificate issued by the educational institution attesting that the minor is enrolled, where applicable – copy
- Psycho-pedagogical sheet drawn up by the educational institution where the child is enrolled, where applicable – copy
- Certificate of disability classification, where applicable – copy
- School orientation certificate (where applicable) – copy
