MONITORING OF FAMILY RELATIONSHIPS – PARENT/CHILD

The parent whose personal relationship with the child is affected by non-compliance with the civil judgment or notarial agreement regarding the visitation schedule for the minor(s).

Monitoring consists of representatives of the Child and Family Protection Service within the Community Social Services Administration Ploiești attending the collection of the child by the parent with whom the child does not normally reside, visits made to the child’s residence by the parent who does not live with them, the return of the child by the parent who does not live with them, as well as supervision during the time the child is hosted by the parent with whom the child does not normally reside, where the court has ordered monitoring through an enforceable judgment.

During the monitoring, representatives of the public social assistance service or, as applicable, persons with social assistance duties interview the parents, the child, the persons with whom the child interacts, as well as other persons whose interview is deemed useful for drafting the monitoring report.

What is the applicable legislation?

• • Law no. 272/2004, republished, on the protection and promotion of children’s rights, with subsequent amendments and additions
• • Law no. 156 of 2023, on the organisation of activities to prevent the separation of children from their families.
• • Government Decision 691/2015 (HG 691/2015) for the approval of the Procedure for monitoring the upbringing and care of children whose parents have gone to work abroad and the services they may benefit from, as well as for the approval of the Methodology of cooperation between the General Directorates for Social Assistance and Child Protection and the public social assistance services and the standard model of documents drafted by them

What are the steps the citizen must follow?

• The person registers the notification.
• Accepts the invitation from SPCF representatives and participates in counselling sessions aimed at parental responsibility and the restoration/maintenance of personal ties with the child.
• Complies with the civil judgment or notarial agreement, cooperating with SPCF representatives
• Complies with the proposals of SPCF representatives in the monitoring report.

What documents must the citizen prepare?

• Birth certificate of the child/children
• Identity card of child(ren) over 14
• Applicant’s identity card
• Parents’ marriage certificate
• Court decision/notarial deed of divorce and exercise of parental authority
