ISSUANCE OF BIRTH CERTIFICATE / NEWBORN REGISTRATION
The child has the right to establish and preserve their identity. The child is registered immediately after birth and from that point has the right to a name, the right to acquire citizenship and, where possible, to know their parents and to be cared for, raised and educated by them.

Detailed information and forms – SPCLEP Ploiești
- 30 days from the date of birth – for a child born alive and still living.
- 3 days from the date of birth – for a stillborn child.
- 24 hours from the date of death – for a child who died within 15 days of birth.
Exceeding the deadlines: If the declaration is made within one year of the birth, the approval of the Mayor of the Municipality of Ploiești is required. If the declaration is made more than one year after the birth, the opinion of D.J.E.P. Prahova and the approval of the Mayor of the Municipality of Ploiești are required.
The birth declaration is made by either parent. If they are unable to declare it, the obligation falls on the doctor, the persons present at the birth, the social worker or, where applicable, the person with social assistance duties at the medical unit where the birth took place, or any person who became aware of the child’s birth.
Required documents – case selection (declaration within the deadline)

- The newborn’s medical certificate.
- Valid identity documents of the parents (BI/CI/CIP/CEI/CIS) – in original.
- Marriage certificate – in original.
- If declared by another person (not one of the parents): the declarant’s identity document + notarised declaration regarding the child’s residence (if the parents have different residences).
- Different family names of the parents – written declaration signed by both parents (before the civil status officer or notary) regarding the child’s name.
- The newborn’s medical certificate.
- Valid identity documents of the parents – in original.
- Birth certificates of the parents – in original.
- Divorce certificate or divorce judgement (legalised, stamped, signed, marked “final”), for mothers who were previously married.
- The presence of both parents is mandatory (for establishing filiation/name).
- The passport of the foreign citizen parent(s).
- Marriage certificate (if applicable):
- issued in Romania or
- issued abroad (plain / with apostille / super-legalised), translated and legalised.
- Declaration given before the civil status officer, with the assistance of an authorised translator – for the recognition of paternity and the child’s name (when the foreign citizen parents are not married).
Declaration after the deadline expires (late)
The birth certificate is drawn up upon the written request of the declarant, with the approval of the mayor of the UAT (administrative-territorial unit) where the event occurred. If the declaration is made more than one year later, the opinion of D.J.E.P. Prahova is also required.
- Application (to the competent SPCLEP/town hall or to the SPCLEP/town hall of residence of one of the parents/persons).
- The birth medical certificate (standard form, with registration number, certain date, stamp/seal, signature and physician’s seal).
- The parents’ marriage certificate (original). If they have different names – joint declaration regarding the child’s name (before the civil status officer or notary).
- Valid identity documents of the parents and of the declarant (if the mother is not the declarant).
- Recognition of a child born outside marriage – the father’s declaration before the officer registering the birth + the mother’s consent (a minor father may recognise the child alone if he proves discernment through psychiatric expertise).
- If the parents’ marriage took place abroad and is not transcribed: urgent transcription/registration of the document, then registration of the birth.
- No medical certificate: a forensic medical assessment regarding the date of birth (year, month, day) and the child’s sex is required.
The provisions also apply to births that occurred abroad, undeclared or registered with inaccurate data, when the registration is made in Romania.
- Application at the competent SPCLEP/town hall or at the SPCLEP/town hall of residence of one of the parents/of the unregistered adult, or at the headquarters of the institution concerned.
- Birth medical certificate (conditions as above).
- The parents’ marriage certificate (original). If they have different names – joint declaration regarding the child’s name.
- Valid identity documents of the parents and of the declarant (if the mother is not the declarant).
- Recognition of the child born outside marriage by the father + the mother’s consent (mentioning the child’s name).
- The documents required for the “children under 14 years old” category must be presented and the declaration of the person whose birth was not registered and, where applicable, of the parents/legal guardian, with 2 photographs of 3×4 cm.
- The declarations are made before the civil status officer/staff with civil status duties.
The declarant’s written application is accompanied by:
- Birth medical certificate.
- The person’s declaration (before the civil status officer/staff with civil status duties) + 2 photographs of 3×4 cm.
- Declaration of two family members or, in their absence, of two persons who know the individual – given before the civil status officer.
- A. Establishing the first name: on the date of registration, based on the birth declaration. If the first name on the medical certificate differs from the one declared, a written declaration is filed, signed by both parents (before the civil status officer or notary) regarding the correct first name.
- B. Indecent or ridiculous first names: the civil status officer may refuse registration; the parents will choose an appropriate name.
- C. Child born with an unknown father (— no father): if the mother declares she is not married (as shown by her ID + birth certificate), the child is registered with the mother’s name; the “father” fields are not filled in.
- D. Child born during the marriage: the father is presumed to be the mother’s husband; the child takes the common family name or, if the parents have different names, the name of one of them or the combined names – by agreement of the parents, declared at the Civil Status Office (with both parents present) or before a notary.
- E. Child born outside marriage: takes the name of the parent towards whom filiation was first established; if the father has not recognised the child, the child takes the mother’s name and the “father” field is crossed out (—). Subsequently, by establishing filiation towards the other parent and with the parents’ agreement, the child may take the name of that parent or the combined names; this is declared at the civil status service (in the absence of agreement, the guardianship court decides).
- F. Child resulting from an extramarital relationship of a married mother: in the documents, the father is presumed to be the mother’s husband. To contest paternity: the birth certificate is first obtained (father = mother’s husband), then a court action is initiated; after the final judgement, the parents appear before the Civil Status Office for the recognition of paternity and the establishment of the child’s name.
- G. Parents with different residences: the parent who declares the birth submits a declaration regarding the child’s residence; if another person makes the declaration, a notarised declaration from either parent regarding the child’s residence is required.

- The declarant/both parents (where applicable) appear with the original documents.
- The civil status officer scans the documents and registers the birth in SIIEASC (the Integrated IT System).
- The declarant verifies and signs the Birth Registration Declaration on the PAD.
- The officer verifies the Birth Record and issues the Birth Certificate to the applicant.
