SALE OF ANL DWELLINGS
Natural persons who own an ANL apartment.
Brief description of the sale procedure:
- Receipt of the purchase request from the tenant;
- Verification of the validity of the contract and compliance with contractual provisions;
- Verifications at ANCPI (the National Agency for Cadastre and Real Estate Advertising), the Public Local Finance Service, and the specialised directorates and services within the Ploiești Municipality Town Hall;
- Absence of litigation
- Existence of the formalities of real estate publicity
- Review of the documents submitted by the applicant together with the verifications carried out (services, directorates, offices, etc.) and establishment of sale prices by the specialised commission within the Ploiești Municipality Town Hall
- Initiation of a Local Council Decision and approval by Specialised Commission no. 2 of the Local Council of the Municipality of Ploiești
- Adoption of the Local Council Decision
- Conclusion of the Sale-Purchase Contract

What is the applicable legislation?
• Law no. 152/1998 on the establishment of the National Housing Agency, republished, as subsequently amended and supplemented;
• Government Emergency Ordinance no. 99/2006 on credit institutions and capital adequacy, as subsequently amended and supplemented;
• Law no. 227/2007 approving Government Emergency Ordinance no. 99/2006 on credit institutions and capital adequacy, as subsequently amended and supplemented;
• Law no. 493/2003 approving Government Ordinance no. 81/2003 on the revaluation and depreciation of fixed assets owned by public institutions, as approved, with subsequent amendments and supplements;
• Order no. 3471/2008 approving the Methodological Norms on the revaluation and depreciation of tangible fixed assets owned by public institutions, as subsequently amended and supplemented;
• Ordinance no. 22/24.08.2022 amending Law 152/1998 on the establishment of the National Housing Agency.

• Government Decision no. 81/30.01.2023 amending and supplementing the Methodological Norms for the implementation of the provisions of Law no. 152/1998 on the establishment of the National Housing Agency, approved by Government Decision no. 962/2001.
• Local Council Decision of the Municipality of Ploiești no. 88/28.02.2023 approving the amendment of the Regulation on the sale of housing built for young people through the National Housing Agency located in the Municipality of Ploiești, approved by Local Council Decision of the Municipality of Ploiești no. 425/2019, as subsequently amended and supplemented;
– submission of the application for purchase of the dwelling (Annex no. 3 of Local Council Decision of the Municipality of Ploiești no. 88/28.02.2023), accompanied by the documents required for the purchase of youth housing built through ANL (Annex no. 4 of Local Council Decision of the Municipality of Ploiești no. 88/28.02.2023);
– Proof of payment of the equivalent of the sale price of the ANL dwelling and notification of the Notary Office where the conclusion of the corresponding Contract is requested.
- standard application for the purchase of the dwelling, in the form provided in annex no. 3 of the Regulation on the sale of housing built for young people through the National Housing Agency located in the Municipality of Ploiești;
- statement authenticated by a notary public showing that the holder of the rental contract and the members of his or her family – husband / wife, children and / or other dependants – do not own another dwelling, including holiday homes, except for shares of a dwelling acquired in accordance with the law, provided they do not exceed the useful surface of 37 sqm, the minimum useful surface per person, provided for by Law no. 114/1996, republished, as subsequently amended and supplemented;
- statement authenticated by a notary public showing that the holder of the rental contract and the members of his or her family – husband / wife, children and / or other dependants – do not hold, at the date of conclusion of the sale-purchase contract, a plot of land allocated under the provisions of Law no. 15/2003 on support granted to young people for the construction of a personal property dwelling, republished;
- certificate issued by the employing unit containing the average net income per family member earned in the last 12 months in which the purchase application is made / before the month in which the sale takes place, for the adult family members mentioned in the contract;
- fiscal certificate from the Public Local Fiscal Service for the holder of the rental contract and the members of his or her family – husband / wife, children and / or other dependants, mentioned in the contract;
- certificate issued by the Tenants’ Association showing the up-to-date payment of common maintenance fees;
- the rental contract must be valid at the date of the purchase application as well as at the date of sale;
- photocopy of the birth certificate, marriage certificate and identity document – for husband, wife and adult family members.
