MONTHLY ALLOWANCE FOR PERSONS CLASSIFIED IN THE SEVERE DEGREE OF DISABILITY WITH PERSONAL ASSISTANT

The parents or, as applicable, the legal representatives of a child with severe disability, the person or family who has placed in foster care a child with severe disability, adults with severe disability or their legal representatives, except those with severe visual disability, may choose between a personal assistant and the receipt of a monthly allowance.

The monthly allowance is the monthly financial benefit consisting of sums of money granted to persons with disabilities to facilitate equalisation of opportunities, ensure an autonomous life and promote their social inclusion;

Payment of the monthly allowance is provided by the local councils (primării) in whose territorial jurisdiction the person with severe disability has his or her residence. 

The allowance is paid for the period of validity of the certificate of disability classification, issued by the child protection commissions or by the assessment commissions for adults with disabilities, as applicable.

What is the applicable legislation?

  • Law no. 448 of 2006, republished, on the protection and promotion of the rights of persons with disabilities
  • Order no. 794/2002 approving the method of payment of the allowance due to parents or legal representatives of a child with severe disability, as well as the adult with severe disability or his or her legal representative
  • Decision no. 268 of 2007, as updated, approving the Methodological Norms for the implementation of the provisions of Law no. 448/2006 on the protection and promotion of the rights of persons with disabilities
  • Law no. 292 of 20 December 2011 on social welfare, as updated.
  • Law no. 190 of 2018 on measures for the implementation of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation)
What steps must the citizen follow?ExpandCollapse

Submission of the following documents:

  • bank account statement – for adults with disability, the account will be opened in their name, and for adults with disability who have a legal representative, in accordance with the operative part of the court decision
  • application for the granting of the monthly allowance (NOTE! The corresponding type of application must be selected: adult, adult with legal representative, child), accompanied by the following documents:
  • identity document / birth certificate of the person with disability (as applicable) – original
  • identity document of parents / legal representative / contact person in case of emergency – original (as applicable)
  • certificate of disability classification, including the annex – copy
  • consent issued by DGASPC Prahova regarding the option of the parents / legal representatives of the child with severe disability, or of adults with severe disability / their legal representatives, for granting the monthly allowance – original
  • pension slip for adults classified in the degree of disability who have pensioner status

NOTE!

For children classified in the degree of disability, in order to avoid undue payments, parents must be informed about the following:

  • if they have their domicile / residence in a locality other than Ploiești, they will attach a certificate issued by the social welfare service of the locality of domicile / residence stating that no application for granting the monthly allowance has been registered
  • the applicant must be informed that, in certain special situations, ASSC Ploiești may also request other documents (e.g. the order to terminate the allowance upon change of domicile)
