Issuance of Certificate of Attestation of Construction/Extension of Building
The right X Jurisprudence of ownership over buildings is registered in the land registry on the basis of a certificate of attestation issued by the local authority that issued the building permit, confirming that the construction was carried out in accordance with the building permit and that there is an acceptance report at the completion of works, as well as in compliance with other legal provisions in this matter, and on the basis of cadastral documentation.
In the case of buildings whose works were carried out without a building permit, and the expiry of the limitation period provided in art. 31 of Law 50/1991 no longer permits the application of sanctions, the certificate of attestation/affidavit regarding the construction of the building shall be issued on the basis of a technical expert opinion regarding compliance with the applicable fundamental requirements concerning quality in construction, including compliance with the approved urban planning regulations, which shall confirm the current situation of the buildings and compliance with the provisions in this matter, and on the basis of cadastral documentation.
Ownership of buildings may also be registered in the land registry by stages of execution, on the basis of the certificate of attestation of the building’s stage of completion, issued by the mayor of the administrative-territorial unit.

Note: If the construction built with or without a building permit is located on a real estate not registered in the land registry (first registration in cadastre and land registry records), the certificate of attestation of construction/extension of the building cannot be issued.
