FEE FOR REVIEWING DOCUMENTATION AND ISSUING THE LOCATION APPROVAL FOR APPLICATIONS RELATED TO STREET COMMERCE AND ADVERTISING IN THE PLOIEȘTI MUNICIPALITY, IN ACCORDANCE WITH HCL 122/2016 AND HCL 95/2022, AS UPDATED
A fee of 74 lei, provided in the advertising and commerce regulations (approved by H.C.L no. 122/2016 and no. 95/2022, as subsequently amended and supplemented) for reviewing documentation and issuing the location approval for applications related to street commerce and advertising in Ploiești, (a fee that is indexed in accordance with the H.C.L. on local taxes and duties).

What is the applicable legislation?
- Law no. 50/1991 on the authorisation of the execution of construction works, republished, as subsequently amended and supplemented;
- H.C.L. no. 95/28.02.2022, as subsequently amended and supplemented, approving the Regulation on the placement and operation of temporary commercial spaces on land belonging to the public and private domain of the Ploiești municipality;
- Law 185/2013 – on the placement and authorisation of advertising means (republished), in conjunction with the Regulation on street advertising in the Ploiești municipality approved by HCL 463/2015 as amended and supplemented by HCL 122/2016.
- H.C.L. no. 200/30.05.2018 approving the Procedure on the organisation and operation of summer terraces with a public food service profile set up in the Ploiești Municipality;
- OUG (Government Emergency Ordinance) no. 57/2019 on the Administrative Code, as subsequently amended and supplemented ;
- Law no. 350/2001 on territorial development and urban planning, as subsequently amended and supplemented
- Law no. 24/2007 on the regulation and management of green spaces in the built-up areas of localities, republished, as subsequently amended and supplemented;
- Administrative procedures approved at the level of the Ploiești City Hall.
Submission → review → approval → issuing of completion notice (where applicable) → drafting of the approval → presentation for review and approval at the meeting of Specialised Committee no. 4 → issuing of the approval by Specialised Committee no. 4 → forwarding of the approval to the beneficiary, to the relevant directorates within the Ploiești City Hall, the Ploiești Local Public Finance Service, S.G.U. S.R.L., S.C. Hale și Piețe S.A., etc.
Submission of documents:
– Registry of the Ploiești City Hall (Piața Eroilor no. 1 A) or, where applicable (those that do not require the approval of Specialised Committee no. 2), at the Registry of the General Directorate of Urban Development at the municipality’s headquarters at Piața Eroilor no. 1A and at the e-mail address of the D.G.D.U. dir.urbanism@ploiesti.ro .
Document review:
– The documentation is reviewed/analysed by an advisor within the Urban and Metropolitan Development Office (C.D.U.M.) and is subsequently presented to the management of the D.G.D.U. (the Deputy General Director and the Chief Architect) to review and approve the position issued by the C.D.U.M.
Approval – The documentation is presented in the meetings of Specialised Committee no. 4 for issuing the approval.
Contents of the files containing the required documents (where applicable):
1). For street commerce documentation:
– application – signed and stamped by the legal representative of the economic operator,
– copy of the receipt showing payment of the location approval fee,
– registration certificate from the Trade Register – copy,
– site plan[1] – produced on an updated topographic base provided by the D.G.D.U. through Cadastre and Technical Documentation Verification, scale 1:1000 – 1:2000, containing the analysis of the requested location/locations by drawing all placement restrictions and prohibitions as established by the present regulation, and delineating the permitted areas – one copy, in original, stamped and signed by the beneficiary,
– extract from the company statute – showing that the principal or secondary object of activity is the marketing of services or products consistent with the proposed profile – copy,
– 3D simulation – in accordance with the site plan and supporting technical memorandum;
– tax certificate showing payment of obligations to the local budget;
– proposed travel route and stationing locations for the sales structures specified in section III.2.3, accompanied by the position of the Traffic Committee – one copy, in original, stamped and signed by the beneficiary.
2). For summer terraces:
– application;
– copy of the registration certificate at the Trade Register Office – unique registration code;
– copy of company statute (extract of object of activity);
– tax certificate showing payment of obligations to the local budget issued by the Ploiești Local Public Finance Service;
– Constative certificate showing that the company is not subject to litigation, judicial reorganisation or insolvency;
– Proof of own working point with an authorised public food service profile (in the case of economic operators that will set up welcome terraces):
– constative certificate from the Trade Register Office;
– authorisation for carrying out public food service activities;
– title of ownership or rental/loan-for-use/association contract for the space;
– dimensioned site plan of the working point and of the proposed terrace.
– Proposal for arranging the terrace:
– dimensioned site plan;
– terrace surface area;
– description of the type of furniture;
– proposed location complying with the conditions in the procedure;
– 3D simulation or photo with the mandatory elements from the procedure.
3). For street advertising documentation;
– application – signed and stamped by the legal representative of the economic operator,
– copy of the receipt showing payment of the location approval fee,
– registration certificate from the Trade Register – copy,
– site plan drawn up by an authorised designer with OAR (Order of Romanian Architects) or RUR (Register of Romanian Urban Planners) signing rights – produced on an updated topographic base provided by the D.G.D.U. through the Cadastre and Technical Documentation Verification Service, scale 1:1000 – 1:2000, containing the analysis of the requested location/locations by drawing all placement restrictions and prohibitions provided in the regulation, and delineating the permitted areas,
– the model of the proposed advertising structure or the proposed assembly (in the case of special advertising projects) – documentation drawn up by an authorised designer with OAR or RUR signing rights, using diagrams, sketches, perspectives, axonometries, photographic documents or any form of illustration relevant for assessing both the placement requirements and the architectural quality and treatment requirements imposed by the regulation. In the case of placement in architecturally or urbanistically protected areas, the position/approval of the Prahova County Directorate for Culture and National Heritage shall be presented as mandatory – documentation in original, stamped and signed.
– extract from the company statute – showing that the principal or secondary object of activity is advertising and/or event organisation – copy,
– proposed travel route and stationing locations for the advertising structures specified in section III.2.3, drawn up by an authorised designer (OAR or RUR) and accompanied by the position of the Traffic Committee and the Road Police – in original, stamped and signed by the beneficiary.
– documents proving use/occupation of the space – where applicable (sale-purchase contract, rental contract, loan-for-use), in copy,
– written consent of the owner of the space on which the advertising system will be mounted,
Presentation memorandum giving a complete description of the advertising system (materials used, dimensions, advertising message, colours, etc.),
Photo simulation showing the existing situation and the proposed one.
In the case of an application for issuing the location approval for advertising means on buildings owned by public institutions or serving as their headquarters, the site plan and the model of the proposed advertising structure may be replaced by simplified documentation, with the same content, which may be drawn up by the applicant – public institution without requiring the signature of an authorised designer (OAR or RUR), except where the property is a monument classified by law.
